BOT to Hear Two Settlement Offers Tomorrow

In addition to the monthly agenda, the Village Board of Trustees will address two separate legal matters and possible settlements tomorrow evening.

The settlement discussions will occur during executive sessions, which are closed to the public. However, voting to accept a settlement or not will take place in a future public meeting. 
 
At 6:00 PM, the Board will enter an executive session to discuss a proposed settlement of the Madden v. Village of Tuxedo Park, which is an Article 78 filing. The subject of litigation and appellate matters revolves around three FOIL requests. Special meeting agenda and Zoom instructions.

At 8:30 PM, the Board will enter a second executive session to discuss a proposed settlement of The Tuxedo Club, Inc. v. Tuxedo Park Village lawsuit, an assessment challenge, real property tax certiorari case currently in Orange County, NY Supreme Court. The litigation is based on a new valuation standard, where courts throughout the County, including New York State, have recently adopted a different valuation methodology for golf clubs, regardless of their luxurious facilities. This methodology is based on the idea that golf clubs, private or public, are not-for-profit entities that exist solely for the benefit of their members. Regular meeting agenda and Zoom instructions.
